Moved by Commissioner Davis, supported by Commissioner Arnold, to accept the minutes of the Regular Meeting of July 16, 2003, as submitted. Ayes all.

ITEM NO. 2 -- APPROVAL OF AGENDA

1. Regular Meeting – August 20, 2003

Chairman Cebulski informed the Commission that Application 1734/0502, Meridian Square Office Building, was tabled at the request of the applicant; that the Standard Federal sign request was withdrawn at the request of the applicant; and that Application 1452/397, Frank A. Bauss, would be an addendum to the agenda under Item 3, Set Date for Public Hearing.

Moved by Commissioner Davis, supported by Commissioner Arnold to approve the Agenda for the Regular Meeting of August 20, 2003, as amended. Ayes all.

Mrs. Barney gave a PowerPoint presentation of the area. Amy Neary of McKenna Associates reviewed their report and the Fire Department report was received.

Mr. David Birchler addressed the Commission, presented drawings, and answered questions on behalf of the applicant.

Chairman Cebulski opened the Public Hearing at 7:27 p.m.

The following residents of the area expressed their objections to the proposed rezoning: Jeff Montgomery, John Roan, Terry Webner, John Wild, Ron Hurley, James Patton, Joann Walker, Dwight Dean, Larry Carver, Robert Towne, Charles Washburn, and Carol Geary. Concerns centered on the impact of increased density of housing, the possibility of reduced property values, possible reduced water pressure, and increased traffic congestion.

There being no further comment, the Public Hearing was closed at 7:44 p.m.

Moved by Commissioner Davis, supported by Commissioner Karell, to recommend to the Board of Trustees denial of the request for rezoning from R-1-E, Single Family Residential, to R-1-S, Single Family Residential, Application 1799/0603, Allie F. Fayz, based on the following reasons:

1. The requested rezoning is not consistent with goals and policies of the Township Master Plan.
2. The current R-1-E is more consistent with the Future Land Use Plan than the requested R-1-S.
3. The requested rezoning could establish an undesirable zoning trend in the Township, which would undermine the orderly transition of densities.
4. The current R-1-E zoning is more appropriate to the nearby pattern of land division and housing development than the requested R-1-S zoning.

Ayes all, except for Commissioner Mueller who abstained because of a possibility of a perceived conflict of interest.

Moved by Commissioner Barberena, supported by Commissioner Arnold, to recommend approval of the land split requested in Application 1801/0703, Welsh Properties, subject to the conditions listed in the reports of McKenna Associates and Dietrich Bailey. Ayes all.
