ITEM NO. 1 -- APPROVAL OF MINUTES

1. Regular Meeting – September 17, 2003

Moved by Commissioner Davis, supported by Commissioner Arnold, to approve the minutes of the Regular Meeting of September 17, 2003, as submitted. Motion carried unanimously.

2. Special Meeting – October 1, 2003

Moved by Commissioner Davis, supported by Commissioner Pratt, to approve the minutes of the Special Meeting of October 1, 2003, as submitted. Motion carried unanimously.

3. Work Session – October 1, 2003

Moved by Commissioner Davis, supported by Commissioner Arnold, to approve the minutes of the Work Session of October 1, 2003, as submitted. Motion carried unanimously.

ITEM NO. 2 -- APPROVAL OF AGENDA

1. Regular Meeting – October 15, 2003

The agenda was amended by the addition of Application 1781/0203, Durr Industries Temporary Trailer, under Item No. 8—Other Planning Commission Business. Commissioner Davis then moved to accept the agenda for the Regular Meeting of October 15, 2003, as amended. Seconded by Commissioner Arnold. Motion carried unanimously.

ITEM NO. 3 -- SET DATE FOR PUBLIC HEARING

   Project Name:  
   Location:  North side of Ann Arbor Trail, east of Beacon Hill Drive, west of Beacon Hollow Condominiums and Pinecrest Court
   Zoning:  R-1-H, Single Family Residential District
   Action Requested:  Applicant is requesting to rezone the subject property from R-1-H, Single Family Residential to R-1, Single Family Residential.

Community Development Director Barney indicated that the applicant amended his application to request R-1, Single Family Residential.

Chairman Cebulski read communications received from Township Attorney Ron Witthoff, Ms. Hodges of McKenna Associates, and Public Services Director Jim Anulewicz regarding the possibility of the 1993 Land Use Map being in error, the process for correction, and the need for tabling this application until past records can be researched.

Mr. Frank Bauss addressed the Commission with his wishes for cooperation and expeditious settlement of his request.

Moved by Commissioner Arnold, supported by Commissioner Pratt, to table Application 1812/0903, Frank A. Bauss, for up to 60 days, directing an expeditious resolution of the outstanding items. Motion carried unanimously.

Moved by Commissioner Sturdy, supported by Commissioner Pratt, to direct McKenna Associates, Community Development Director Barney, and the Township Attorney to quickly review the Master Land Use Plan for errors and to make any corrections that may be necessary. Motion carried unanimously.

ITEM NO. 4– PUBLIC HEARINGS-N/A

ITEM NO. 5 -- OLD BUSINESS

   Action Requested:  The applicant is requesting Final Site Plan Approval and approval of the Single Family Cluster Housing Agreement.

Amy Neary reviewed the report of McKenna Associates, Mrs. Barney reviewed the concerns listed in the Fire Department report and Michael Bailey reviewed the report of Dietrich Bailey Associates.

Mr. Salvatore Cristarella presented plans and answered questions.

Moved by Commissioner Davis, supported by Commissioner Pratt, to recommend final site plan approval and approval of the Single Family Cluster Housing Agreement for Application 1794/0503, Salvatore Cristarella, subject to the applicant meeting all the Fire Department requirements, the Dietrich Bailey requirements of the sewer and landscape, and subject to the approval of the Township Attorney of the Master Deed and Bylaws and the approval of the Community Development Director. Motion carried unanimously.

Ms. Neary reviewed the report of McKenna Associates, the Fire Department report was received, and Mr. Bailey reviewed the report of Dietrich Bailey.

Mr. Dragan Stojanov addressed the Commission and answered questions.

Moved by Commissioner Barberena, supported by Commissioner Mueller, to grant tentative site plan approval to Application 1808/0803, Archie LLC, with building elevations, materials, and colors to be reviewed for approval at presentation of the final site plan. Motion carried unanimously.

ITEM NO. 6 -- NEW BUSINESS

The reports of McKenna Associates and Dietrich Bailey were reviewed, and the Fire Department report was received.

Mr. Doug Manix of Campbell-Manix, Inc. and Mr. Gregory J. Blackwood of GB Sales and Service, Inc., presented plans and addressed the Commission.

Moved by Commissioner Davis, supported by Commissioner Pratt, to grant tentative site plan approval to Application 1811/0903, Campbell-Manix, Inc. Motion carried unanimously.

ITEM NO. 7 -- ANN ARBOR ROAD SIGN REQUESTS

1. Standard Federal, 40909 Ann Arbor Road
    Southwest corner of Ann Arbor Road and Haggerty
    Tax I.D. 065-99-0007-001

Ms. Neary reviewed the report of McKenna Associates.

Mr. Gary Childress, representing the sign company, addressed the Commission and presented plans.

It was moved by Commissioner Pratt, supported by Commissioner Arnold, to approve the Standard Federal sign at 40909 Ann Arbor Road as presented, the base to be either the brick color of the building or Wyandotte Modular which is the standard for the ARC District, subject to Building Department approval and measuring the correct setback. Motion carried unanimously.

2. Riverbank Square, 521 - 561 Ann Arbor Road
    South of Ann Arbor Road, east of Rocker Avenue and west of Lilley Road
    Tax I.D. 061-99-0005-002

Ms. Neary reviewed the report of McKenna Associates and noted there was not sufficient room on the site for compliance with the required 10-foot setback, thus a variance would have to be requested of the ZBA.

Mr. Rex Roach of the sign company presented plans and answered questions.

Moved by Commissioner Pratt, supported by Commissioner Davis to table consideration of the sign for Riverbank Square, 521-561 Ann Arbor Road, to allow time for requesting a setback variance from the ZBA and for time to redesign the sign to fit the requirements of the ARC District. Motion carried unanimously.

ITEM NO. 8 -- OTHER PLANNING COMMISSION BUSINESS

    Applicant/Developer: Emrick Orchard Estates Condominiums

    Location: North side of North Territorial, east of Beck Road

Ms. Barney noted the application was referred to the Planning Commission from the Building Department because Emrick Orchard Estates was developed under the Single Family Cluster Housing Option and the site plan did not include gates.

Mr. Keith Kecskes, attorney for Mr. Menard, addressed the Commission and answered questions.

Moved by Commissioner Arnold, supported by Commissioner Sturdy, to approve Application 1310, Emrick Orchard Estates Condominiums, subject to the Chief Building Official being asked to approve the final placement after consulting with the Fire Department and the Fire Department consulting with Mr. Menard as to how to access the gates. Motion carried unanimously.

   Action Requested:  Applicant is requesting an extension of the approval for temporary structure.

Moved by Commissioner Pratt, supported by Commissioner Arnold to extend the approval for the temporary structure requested in Application 1781/0203, Durr Industries, to December 31, 2003. Motion carried unanimously.

ITEM NO. 9 -- COMMUNICATIONS &/OR INFORMATION

1. Discussion of Ann Arbor Road Standard Design Details

Amy Neary of McKenna Associates presented drawings of the proposed traffic lights, street lights and gateway structures for the Ann Arbor Road corridor.

ITEM NO. 10 -- BOARD OF TRUSTEES ACTION-N/A

MOTION TO ADJOURN

Moved by Commissioner Mueller, supported by Commissioner Davis, to adjourn the meeting.
Motion carried unanimously.
