ITEM NO. 1 - APPROVAL OF MINUTES
1. Regular Meeting – July 8, 2004
Moved by Mr. Sturdy, supported by Mr. Jachym, to approve the minutes of the
Regular Meeting of July 8, 2004, as presented.
APPROVAL OF AGENDA
Mr. Sturdy indicated that in the minutes of the July 8th meeting Application
1372, 11370 Parkview, was tabled for further review by the Building Department
as to whether a variance was needed under the new Zoning Ordinance. Subsequent
to that meeting, a determination was made that a variance was not required and
Application 1372 was withdrawn; therefore, that application is no longer before
the Board. Mr. Sturdy then moved to approve the Agenda for the Regular Meeting
of August 5, 2004. Supported by Mr. Jachym.

The applicant is requesting one variance:
1. The existing residential property should have a minimum side yard setback of
ten (10) feet. With the proposed three-car front entry garage addition, the side
yard setback would be seven point five (7.5) feet. The applicant is requesting a
variance for side yard setback of two point five (2.5) feet.
Mr. Sturdy presented a letter received from neighbors David and Sandra Hahn
indicating a concern regarding the affect of the proposal on property values.
Applicants Andrew and Linda Glovatsky addressed the Board and answered
questions. They presented photographs and two letters from other neighbors who
had no objections.
The Board discussed the practical difficulty because the house is not centered
on the lot and the presence of an unusual curve in the front lot line and street
resulting in the house immediately west being situated several feet in front of
the extended front building line of applicants’ home. They felt that the
proposal to extend the garage with aluminum siding rather than brick as on the
existing garage was a valid concern.
Moved by Mr. Sturdy, supported by Mr. Jachym, to modify the administrative order
suspending the currently issued building permit for the garage construction at
44851 Partridge, Application 1374, to permit its issuance upon approval by the
Building Department of new plans which will demonstrate the use of brick for the
first story of the garage addition. With that in place, the 2.5-ft. variance on
the west side of the property is approved.

The applicant is requesting one variance:
1. The existing residential property is located on a corner, with a less than
minimum rear yard setback. With the proposed variance, the fence placement would
be located three feet off the front property line. The applicant is requesting a
variance for fence placement.
Applicant Michael Huff presented letters signed by eight adjacent neighbors on
Rocker and Main indicating no opposition to the proposed fence placement,
addressed the Board and answered questions.
Moved by Mr. Levengood, supported by Mr. Sturdy, to grant the front yard fence
placement at 43375 Judson, Application 1375, because of the uniqueness of the
placement of the house on this particular lot.
